Terms of service

These Terms of Service (“Terms”) govern all services, sales, and engagements between Found Surface, LLC (“Found Surface,” “we,” or “us”) and any client, customer, or company (“Client”). By engaging our services, purchasing products, or otherwise working with Found Surface, the Client agrees to these Terms.

1. Product Development Services

1.1 Scope of Work

Found Surface provides design, development, and production-related services across one or more projects. Each project will begin with a written quote outlining the scope of work, deliverables, estimated labor, and material costs.

A  non-refundable deposit is required before work begins. Additional invoices may be issued throughout the project to reflect work performed, approved scope changes, revisions, or additional services. Payment terms beyond the standard deposit may be negotiated on a case-by-case basis.

These Terms serve as an umbrella agreement governing all projects, invoices, and engagements between Found Surface and the Client.

1.2 Additional Services & Billing

If a project requires additional time, revisions, or services beyond the original quote, such services will be billed at Found Surface’s prevailing rates (including, but not limited to, sampling, swatching, grading, and digitizing).

Found Surface reserves the right to issue additional invoices to accurately reflect services rendered. The Client acknowledges responsibility for all such charges.

1.3 Materials & Third-Party Services

Costs for materials and services—including fabric, trims, tags, notions, dyeing, embroidery, printing, and finishing—are billed to the Client as incurred.

Found Surface may purchase and invoice these items without prior approval when necessary to maintain approved project timelines. 

2. Production & Sales Terms

2.1 Payment Terms 

  • Payment Terms: A fifteen percent (15%) deposit is required to book the project. Thirty percent (30%) is due upon project start. The remaining fifty-five percent (55%) is due prior to the release or shipment of any deliverables. All deliverables remain the property of the service provider until payment is received in full.


  • Delivery dates are estimates only and not guaranteed.

  • Modifications made after order submission may result in revised pricing and timelines.

2.2 Products & Services

All products, services, and lead times are subject to change at Found Surface’s discretion.

Minor production losses of up to 10% are considered standard within the apparel industry and will be reflected in final invoicing.

2.3 Modifications to Services & Pricing

Found Surface reserves the right to modify, suspend, or discontinue any service or product at any time. Pricing is subject to change without prior notice.

3. Warranties & Limitations

Disclaimer of Warranties

All services and products are provided “as is”, without any express or implied warranties.

Limitation of Liability

Found Surface is not liable for any indirect, incidental, consequential, or special damages arising from the use of its products or services.

Acceptable Quality Standards

Due to the nature of apparel manufacturing, a 90% usable product rate is considered acceptable. Minor imperfections (including seam variations or small inconsistencies) are not grounds for rejection.

Client Responsibility

Claims resulting from unclear instructions, incomplete information, or inaccurate purchase order details provided by the Client will not be accepted.

Right to Payment

The Client may not assert claims or defenses against Found Surface’s right to payment under any invoice or related agreement.

4. Right to Terminate Engagement

Found Surface reserves the right to terminate any project or engagement at its sole discretion if the Client engages in disrespectful, abusive, or unreasonably difficult behavior that disrupts a professional working relationship.

In such cases, all deposits and payments remain non-refundable, and the Client is responsible for any outstanding balances related to services or materials provided up to the termination date.

5. Shipping & Delivery

Clients are responsible for all shipping and logistics costs.

If a shipping account is not provided, Found Surface will arrange shipping on the Client’s behalf and invoice the cost plus a 3.5% administrative fee.

6. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law provisions.

7. Acceptance of Terms

By engaging Found Surface for services, paying invoices, or accepting deliverables, the Client acknowledges that they have read, understood, and agreed to these Terms of Service.
